Autobody shops in New York State number in the thousands and are required to meet certain air emission control requirements. As of January 1, 2005 auto body shops, regardless of their geographic location, will need to comply with the revised coating standards, 6 NYCRR Part 228. Additionally, all auto body shops, except for small operations located in Upstate New York, are required to obtain a registration with NYS Department of Environmental Conservation.
On January 9, 2008, EPA issued new requirements [40 CFR 63 Subpart HHHHHH or the 6H NESHAP] for spray application of coatings to motor vehicles and parts. All auto body shops are required, at a minimum, to submit an Initial Notification. The SBEAP has developed an informational fact sheet to assist owners to understand the new requirements as well as a notificatation form to ensure the filing requirements are met.
