Q: Can an individual form an LLC and be eligible for the NYBFLP?
A: No, an LLC is not eligible under the NYBFLP.
 
Q: Can EFARM fund multiple comprehensive nutrient management plans (CNMPs) for one farm?
A: Yes, as long as proper documentation is sent with a completed application and ultimately approved with separate permit numbers.
 
Q: Can the NYBFLP funds be used to purchase a farm residence?
A: No more than 5% of the value of the agricultural property being financed with the bond funds can be used to purchase a residence. The value of the residence is determined by an appraisal that designates the value of the residence separate from the farming operation. If there is a residence on the agricultural property, this appraisal must be submitted with the application.
 
Q: Can the NYBFLP funds be used to purchase seed, fertilizer, feed and pay other day to day operating expenses of the farm?
A: No, bond funds cannot be used for this purpose. This is considered working capital.
 
Q: Do I need to get an air permit/registration?
A: From a business' point of view, it should be a simple question, yet as with most questions that involve regulations, the uniqueness of each business complicates the answer.Let's start by referring to Part 201—Permits and Registrations, section 1.1, paragraph (b) on applicability. The second sentence reads "Unless specifically exempted pursuant to Subpart 201-3, owners and/or operators of air contamination sources must comply with this Part." The definition of air contamination is so broad that this section of the regulation basically requires that EVERYONE will need to get an air permit unless you find a specific exemption. Many times a person on the telephone will say "But I only buy X pounds of chemicals." Unfortunately, in most cases there is NO minimum quantity that will exempt a facility from having to get an air permit. There are, however, several very important exemptions that will exempt the small source, but these exemptions are process specific. Here are a few: The exemption for surface coating activities that use less that 25 gallons per month (does not apply to businesses located in the NYC Metropolitan Area) applies to automotive refinishing, painting and staining wood furniture, painting or lacquering of metal, and coating of fabrics. The exemption for graphic arts processes that emit less that 20 pounds of VOCs per day (does not apply to businesses located in the NYC Metropolitan Area) applies to all graphic arts processes including, lithographic, rotogravure, flexographic, and screen printing. The exemption for stationary combustion installations that have a maximum rated heat input capacity of less than 10 million Btu/hr applies to all facilities throughout the state that burn fossil fuels other than coal. Q: Does a qualifying transaction have to involve real estate that is being purchased or leased?
A: The beginning farmer loan does not have to involve real estate. The only statutory restriction set forth in 147(c)(2) is $250,000 can be used to finance depreciable property and of that $62,500 can finance "used" depreciable property. Therefore, new or used equipment would qualify; including farm machinery, farm buildings, and livestock (other than feeder livestock).
 
Q: Does EFC have any grants for Beginning Farmers?
A: No, EFC does not have grants available for Beginning Farmers at this time.
 
Q: Does SEQR need to be done for every EFARM application?
A: No, SEQR does not need to be done for an individual EFARM application.
 
Q: How can I find a Lender willing to participate in the NYBFLP?
A: Check with your banking institution to see if it participates. If it doesn’t, please ask if they know about the program and ask if they will participate. Refer them to EFC for further information.

Q: How do I apply for SRF funding?
A: All projects must first be listed on the Intended Use Plan for the appropriate SRF. Once the projects are scored, ranked, and listed, the projects for which funds are available must submit a complete application package. For more information, refer to the appropriate program pages.
