The New York State Minority and/or Women Business Enterprises (MWBE) statutes (Executive Law, Article 15-A) were revised to strengthen the existing MWBE programs throughout the State. Please note that there have been changes to the MWBE guidance documents and forms which can be found under our Resource Library. It is the policy of the United States Environmental Protection Agency (EPA) that recipients of financial assistance offer fair share opportunities for agreements and/or sub-agreements to disadvantaged, minority and woman-owned businesses. The New York State Environmental Facilities Corporation (EFC) endorses this policy.
EFC provides comprehensive MWBE Program training, technical assistance, and guidance to recipients of SRF financial assistance. The EFC MWBE-EEO Program is also committed to creating opportunities for minority and women-owned businesses to participate through contracting and subcontracting opportunities on all funded State Revolving Fund (SRF) projects.
EFC administers a goal oriented program as required by Executive Law, Article 15-A. Goals are based on the capacity and availability of qualified, certified MBEs and WBEs in the relevant geographic market for the procurement categories of construction contracts and non-construction contracts.
Effective October 1, 2011, the MWBE goals for the CWSRF/DWSRF & GIGP Programs will be revised. They are based off New York State Department of Environmental Conservation (DEC) regions as follows:

9% DEC Regions 4,5,6,7,8, & 9 (All counties not listed below)
10% Regions 1 & 3 (Suffolk, Nassau, Westchester, Rockland, Ulster, Dutchess, Orange, Sullivan, and Putnam counties)
17% Region 2 (New York City)
WBE:
5% DEC Regions 4,5,6,7,8, & 9 (All counties not listed below)
6% Regions 1 & 3 (Suffolk, Nassau, Westchester, Rockland, Ulster, Dutchess, Orange, Sullivan, and Putnam counties)
8% Region 2 (New York City)
